I'm actually expecting Trump to invoke the Insurrection Act as soon as next Monday, April 21st. Hoping I'm wrong, but I see it as a manifest from Project 2025.

Since the president can order the National Guard into federal service and control it, and pay and benefits to the National Guard are from the federal budget, I think the best that could be hoped for is a passive resistance of some states' National Guard to unconstitutional orders of the president.

A Governor appoints the Adjutant General of the State, he could take a play out of Trump's book and fire and appoint for loyalty, then refuse federalization. But the author doesn't seem to understand that's actually what happened in Arkansas, the Federal troops were deployed when the guard was not compliant to federal command. Still debated as a breach of Posse Comitatus. It did win the day without bloodshed.

Oh Hi, was just throwing out comments, thanks for responding. You do touch on a very interesting concept I've been thinking of…. Voluntary Marshalls. The idea that a court would rule against the Executive branch but the US Marshalls being part of the executive, are powerless to enforce. The idea that there are situations where citizens can act to uphold a law or order, could provide a path to enforcement. Maybe akin to a bail bondsman rendering a defendant to the courts. Taking action with the order in hand was an interesting detail in your thought exercise. I get you are looking to game out or tabletop these things for a very real possibility. I'm thinking the same way.
